The motion for an order of certiorari is dismissed. The motion to adduce new evidence is dismissed with costs. The application for leave to appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 1501-0131-AC, 2016 ABCA 375, dated December 5, 2016, is dismissed with costs.

 

JUGEMENT
