Wawanesa Mutual Insurance Co., [1989] 1 [...] In addition, Esson J.A. was correct in holding that Vandepitte has been impliedly overruled in the course of decisions by the Court, given that in cases where the rule of privity might have been applied, the decision was ignored: Scott, supra.
